This notice explains how Montanaro F.lli S.r.l. processes the personal data of visitors to montanarofratelli.com/en and of people who contact us, under Articles 13 and 14 of Regulation (EU) 2016/679 (GDPR) and the Italian Personal Data Protection Code (Legislative Decree 196/2003, as amended by Legislative Decree 101/2018). The use of cookies is described in the Cookie Policy.

2. What data we process and why

2.1 Browsing data

Like any website, the server hosting this site records some technical data about each visit: IP address, requested page, date and time, outcome of the request, browser type and operating system. This data is needed to run the site, protect it from abuse and investigate any computer crimes. Legal basis: our legitimate interest in the operation and security of the site (Art. 6(1)(f) GDPR). The data is kept for the period set by the hosting provider for these purposes and then deleted.

2.2 Requests sent through the contact forms

The contact forms on the site (home page, product pages and the «Info» window available on every page) ask for your name, email and message and, optionally, phone number, company, address, city and province. We use this data only to answer your request, for example with information or a quotation. Legal basis: steps taken at your request prior to entering into a contract (Art. 6(1)(b) GDPR). Providing the data is optional, but we cannot reply without the required fields.

The site does not store the messages: they are sent by email to info@montanarofratelli.com and kept in the company mailbox for as long as needed to handle the request. If a business relationship follows, the data is kept for its duration and for the period required by law (10 years for accounting and tax records). To protect the forms from spam we use Google reCAPTCHA (see section 2.6).

2.3 Email and other direct contacts

We keep the email addresses and contact details of people, companies and organisations we are in touch with or that have given them to us, for communications related to our business. Legal basis: pre-contractual steps, performance of contracts and our legitimate interest in maintaining relationships with customers and suppliers. Company mailboxes are for business use: a message may also be read by colleagues of the recipient. If you no longer wish to receive our communications, write to us and we will delete your address.

If you accept marketing cookies, Google Ads (through Google Tag Manager) measures how many contact requests come from our advertising campaigns. We do not use the data to show you personalised advertising. Legal basis: your consent (Art. 6(1)(a) GDPR).

3. Who we share data with

The data is not disclosed to the public. It may be accessed by authorised staff of Montanaro F.lli S.r.l. and by suppliers processing it on our behalf, appointed as processors (Art. 28 GDPR): the website hosting provider, the email provider and whoever maintains the site. For the services in sections 2.4, 2.5 and 2.6 the data is processed by Google Ireland Limited, Gordon House, Barrow Street, Dublin 4, Ireland. We may share data with the authorities when required by law.

4. Transfers outside the European Union

Google services may transfer data to the United States. Google LLC participates in the EU-U.S. Data Privacy Framework, recognised as adequate by the European Commission in its decision of 10 July 2023, and also uses the standard contractual clauses approved by the Commission. 5. Your rights

You may ask us at any time for access to your data, rectification, erasure, restriction of processing and portability, and object to processing based on legitimate interest (Articles 15-22 GDPR). Where processing is based on consent, you can withdraw it at any time without affecting processing carried out before. Write to info@montanarofratelli.com or to our registered address; if we are unsure of your identity we may ask you to confirm it.

You also have the right to lodge a complaint with the Italian Data Protection Authority, Garante per la protezione dei dati personali (www.garanteprivacy.it), or with the supervisory authority of the country where you live.

6. Automated decision-making

We do not take decisions based solely on automated processing, including profiling.

7. Confidentiality of email messages

Emails sent by our company and their attachments are intended only for the named recipients and may contain confidential information. If you receive one of our messages by mistake, please do not use or forward it, delete it and let the sender know. The authenticity of the sender and content is guaranteed only for digitally signed documents.

We may update this notice, for example when the services used by the site change. The date of the last update is shown at the top.
